These Terms and Conditions ("Terms") are between you and Data Targeting Solutions, LLC. a North Carolina Limited Liability Company (“DTS,” “we,” “us,” and “our”). By using the datatargetingsolutions.com website, including all pages within the website, or any website(s) belonging to DTS, including landing pages using subdomains and websites through which we provide our services, hereafter referred to as the “Website,” you acknowledge that you have read and understand the most recent version of the Terms and Conditions & Privacy Policy and you agree to adhere all that follows in the Terms. If you do not accept these Terms, you must cease use of this Website.

This document consists of the Terms and Conditions, a Privacy Policy outlining how we use your information--including emails and cookies--and a Disclaimer. We reserve the right to amend these Terms at any time.

This site is not intended for use by minors. If you are a minor (i.e. under the age of 18), please cease use.

This site is intended for US-based businesses as we offer products and services to US businesses only.

1. Intellectual Property.

a. General. You acknowledge the Website is the intellectual property of Data Targeting Solutions, LLC. This includes all content of the website, including but not limited to, the DTS logo, company name, information in verbal and/or graphical form, blogs, materials, unique ideas, and marketing collateral displayed on or downloadable from the Website. We may update or change the content of the Website at any time without giving further notice.

b. Logos and other graphical materials. Our marks, logos, and graphics used on the Website are our property and may not be used in any manner without our prior written approval.

2. Accessing the Website.

a. General. By accessing the Website, you acknowledge it is our Intellectual Property and agree to do nothing that will negatively impact DTS in any way or the experience of other users of the Website.

b. Use Limitations. You may access the Website to learn about DTS in determining whether to enter into a business relationship with us, or to educate yourself through our blog or our Resource page. You are not allowed to download, modify, copy, or republish any portion of the Website without our prior written approval. We may terminate this allowance at any time and/or to anyone. You cannot use any software or service to redirect traffic from the Website to another site nor can you use any device to monitor the Website. 

You are additionally restricted from:

  • using the Website in a way that may cause harm to DTS

  • using the Website in a way that may cause harm to the Website itself

  • harvesting or mining any type of data from the Website, or any similar activity

  • commercializing the content from the Website for your benefit.

c. Restrictions on Information You Can Submit. The information you submit through Website and Other Registration Forms (explained in detail below) cannot be of a defamatory nature, illegal, racist, harmful, or false. Further, you cannot submit contact information belonging to someone else.

  1. We reserve the right to report any such information to the appropriate authorities.

  2. We reserve the right to ignore any solicitations submitted through the aforementioned Forms.

3. Link Policies.

You cannot use links in such a manner that may negatively impact our business in any way, affect traffic to the Website, or negatively impact the experience of any other user. As such, you are prohibited from using website-framing technology on the Website to redirect traffic to your own website or another website or to disparage the Website or DTS in any way. We may place outbound links on the Website to other websites on the Internet that are owned and/or operated by others. We are not responsible for the content on any of these websites. We may delete any such link at any time at our sole discretion.

4. Privacy Policy.

In an effort to be transparent about the information you share with us, we at DTS have developed this Privacy Policy. We collect specific information about you and want to inform you about how we use it. 

We use information about you to understand you and your business needs, and better serve you. More specifically, it allows us to suggest products and information that are relevant to you. Because we respect your privacy, you can change your marketing communication preferences at any time. This includes the ability to opt-out of further communication from us.

a. Collected Information. We collect the following Contact Information about you and your business:

  • Name

  • Email Address

  • Phone

  • Other information, as needed

Oftentimes, we will initially collect only name and email address, or even only email address, through our Registration Forms. Other relevant details, such as company name, title, and postal address, may be collected over the phone or through email conversations. This information may be used to ensure you are representing a valid business within the US.

We also use the technology services of Leadberry (see details below), which uses aggregate data from Google Analytics to inform us of the companies that are visiting our website.

b. Website and Other Registration Forms. Our site is designed to require you to complete a registration form if you are interested in obtaining additional information or products from us. Therefore, those registration forms may require you to give us contact information (such as your name, email, phone number, and/or mailing address). The same goes for registration forms from third party email service providers, social media sites, or on landing pages from third party landing page services. DTS does not engage in the practice of selling or distributing contact information from these forms to other companies.

By completing one of the aforementioned registrations forms, you are giving us express consent to contact you.

If you complete one of the aforementioned registration forms using a non-US email address or role-based (e.g. [email protected], [email protected], etc.) email address, we may remove it from our mailings during one of our periodic contact information reviews.

Contact information from our registration forms is used to deliver requested product information, newsletters, and promotional material to requesters. Sometimes the mailings are handled by a third party fulfillment house (Constant Contact) that requires access to the information on registration forms in order to send you requested materials. 

c. Your information and how we use it. We use your information to help us personalize and improve your query/count and order, data processing, and predictive modeling  experiences with us. We also use your information to notify you of any DTS products and services that might interest you. We do not sell, rent, license, trade, or share any information you give us with other companies.

Email

Email. When you complete a newsletter registration form ("to become a DTS Insider"), you will receive a welcome email series consisting of four emails sent over the course of seven days. You will then receive weekly tips for a few weeks followed by a newsletter every 4-6 weeks. You will sometimes also receive a special offer or other email message within that period between newsletters. A special offer may be a piece of content or related to a product or service. Special offers will vary depending on what may interest you and what we have available to offer.

When you complete a registration form to download a piece of content or other promotional material (e.g. a white paper), you may receive a short series of emails over the course of the next 7-10 days. This email series will contain information related to the downloaded material.

We may use your contact information to send you our newsletter when you complete any of the aforementioned registration forms as well. You can opt-out, or unsubscribe, from future mailings at any time using the unsubscribe link located at the bottom of newsletters and other email marketing messages sent via our email service provider. (See the "Communication Preferences" paragraph below for more details.) As of the amend date listed above, our email service provider for such messages is Constant Contact. Cookies, analytics, and related. We currently contract with Google Analytics and several other online service providers to help manage and optimize our internet business and communications. We use the services of online marketing companies to help us measure the effectiveness of our advertising and how visitors use our site. To do this, we use web beacons and third party cookies on this site. By supplementing our records, this information helps us learn things like what pages are most attractive to our visitors, which of our products most interest our customers, and what kind of offers our customers like to see.

DTS uses services from Squarespace to run this Website, including Squarespace Analytics. DTS also uses services offered by Hotjar.com, Leadberry.com, AddThis.com, and Unbounce.com. These services may collect information sent by your browser as part of a web page request, such as cookies or your IP request. Bottom line: they drop cookies on your device.

  • Hotjar helps us make your Website experience better by providing tools that help us understand visitor engagement. For information on how Hotjar.com collects and uses your information, please refer to Hotjar's privacy policy.

  • Leadberry, focuses on B2B information only. This service uses anonymous aggregate data from Google Analytics to determine the businesses that are visiting our website. They then use third party partners to share with us the publicly available business contact information of employees who work at those businesses. We filter for US data only, automatically filtering out non-US data, because we work with US businesses only.   • AddThis enables the sharing of Website pages by users. There is an AddThis cookie. For information on how AddThis.com collects and uses your information, please refer to AddThis's privacy policy.

  • Unbounce enables us to build landing pages and pop-ups for email consent at specific times we specify (e.g. when someone is leaving certain pages on the site). They use cookie technology in conjunction with their pop-ups. To learn more about how Unbounce uses your information, please refer to Unbounce's privacy policy.

DTS may also utilize other services and social media services for retargeting/remarketing including, but not limited to:

d. Adjusting Your Communication Preferences. You may opt-out of marketing communications from DTS by sending an email to [email protected] or [email protected] with “Unsubscribe” in the subject line. You may also opt-out of email marketing by using the unsubscribe link at the bottom of each email newsletter and special offer sent via a third-party email service provider. You will continue to receive only email messages related to transaction(s) you place over the phone and/or via email and/or through our other product platforms. You may also manage your subscription by requesting an increase or decrease in marketing communication frequency or the type of content you receive. To do this, you may use the link at the bottom of newsletters, special offers, or autoresponder emails; or you may email us at either of the aforementioned emails with “Manage Marketing Communications” in the subject line. In the body of this email, you may specify your request.

5. Legal Disclaimer.

All content on the Website is provided in good faith to you "as is" without any warranty of any kind. Your use of the Website is at your own risk. In no event shall DTS, nor any of its officers, directors, advisors, employees, or agents, be liable to you for any direct, indirect, incidental, consequential, or punitive damages, including lost profits, revenue, or interruptions, arising out of or connected to your use of the Website. We make no warranties, promises, or representations as to the accuracy of the Website. We assume no liability or responsibility for any factual errors, inaccuracies, or omissions on the Website.

6. Severability

If any provision, or provisions, of these Terms is found to be invalid or unenforceable under any applicable law, such invalidity or unenforceable shall not render the Terms invalid or unenforceable as a whole. Rather, such provisions shall be deleted without affecting the remaining provisions.

7. Miscellaneous.

a. Governing Law and Jurisdiction. These Terms of Use shall be governed and interpreted in accordance with the substantive law of the State of North Carolina without regard to its conflict of law provisions. You agree to the exclusive jurisdiction of the courts located within Iredell County, North Carolina. You understand that this website is directed only to residents of the United States.

  1. Any section of these Terms that by its terms and nature is meant to survive the termination of these Terms, shall survive such termination.

b. Entire Agreement. These Terms set forth the entire understanding and agreement between us with respect to the subject matter hereof.
